Court rejected bail of two accused involved in kidnapping, rape

Judicial Magistrate Reasi, Sudesh Sharma rejected the bail application of Mohd Mustaq and Mohd Latif r/o Ransoo, Reasi who are involved in a case of kidnapping and raping a girl of other religion.
According to the police case the prosecutrix accompanied by her father on October 24, 2007 lodged a written report in which it was stated that on June 28, 2007 she was going to her sister's house at Akhnoor. On reaching Domail, the alleged accused persons who were in a car, met her and told her that they are going to Srinagar and they will drop her at Akhnoor. She went with them and on reaching Akhnoor, she asked them to stop the vehicle, but the accused persons did not stop the same and inhaled her something due to which she became unconscious and when she regained conscious she found herself in Srinagar. It was further alleged in the report that she was kept at an unknown place and repeatedly raped by accused Mohd Mustaq. It was after more than four months she managed to escape from the clutches of the accused persons and came back home. Upon this FIR u/s 366/376/34 RPC was registered and investigation was started, accused persons Mohd Mustaq and Mohd Latif have been arrested from Srinagar and arrest of one accused Muzaffar Hussain is still awaited.
Court, after hearing senior Prosecuting officer Rajesh Bakshi and Prosecuting officer Arvind appearing for State and Adv RK Sharma appearing for the accused persons and also going through CD file, observed that investigation of the case is still going on and the offences against the accused persons are heinous in nature. It has also come on record that prosecutrix in her statement recorded u/s 164-A Cr PC has categorically implicated the accused persons with the commission of crime u/s 376/366 RPC. It also appears from the record that one of the accused Muzaffar Hussain is still absconding. Court also considered photocopies of affidavits and Nikahnama which appears to have been executed by some Moneera Bano instead of prosecutrix who belongs to other religion. After considering all the records and the CD file produced by the police, the Court rejected the bail application as the investigation was in process and more so one of the alleged accused was still absconding.
