| Recovery award amount more than Rs 13 lakhs | | Court issues warrant of attachment of account head of DGP | | Early Times Reproter Jammu | June 10 In a significant judgment the Presiding Officer Motor Accident Claim Tribunal Jammu Jang Bhadur Singh Jamwal has issued warrant of attachment of account head No 2055 of Director General of J&K Police with the direction to all the treasury officers in the state not to make any transaction from anywhere so long the entire liability amounting to R.13,70, 989 is not liquidated by the respondents. This order has been passed in a execution petition presented by Adv Vishal Sharma for execution of award dated March 20, 2007 amounting Rs 11, 91, 880 along with interest @ 7% per annum from the date of filling of claim petition till payment is made. Court, after hearing the counsel for the petitioner and scanning the record file, observed that despite dismissal of their appeal by the High Court, the respondents have not chosen to deposit the sum of Rs 13, 70, 989 being award money. Court directed all the Treasury Officers to freeze the account heads of DGP J&K and not make payment of any bill presented before them till further orders from this Court. Court further ordered that a copy of this order be sent to Director General Treasuries for compliance and ordered that all the execution petitions pending against respondent DGP shall come up for further proceedings on June 28, 2008. These significant directions were passed in an execution petition filed by the victim Vishal Kapur through his Counsel Vishal Sharma for execution of the award passed on March 22, 2007 whereas the respondents filed an appeal before the High Court which was dismissed on May 20, 2008.
