‘Misappropriation of over Rs. 93 lakhs’

State Vigilance Organization has produced challans against Shamas-ud-Din Koka, the then Chief Engineer R&B, Kashmir (now retired), five executive engineers and several suppliers in the court of Anti Corruption Judge Srinagar for misappropriation of government money causing loss of Rs. 93.14 lakhs to the state exchequer.
Those challaned included Ghulam Nabi Ganai, the then Executive Engineer R&B Division Qazigund, (now retired) Manzoor Ahmad Dar, the then Executive Engineer R&B Division Khanabal, Mohammad Ajaz Khan, the then Sr. Assistant (Storekeeper) R&B Division Qazigund and Muzamil Ahmad Kochak, Arshid Hussain Koka, Nadeem-ul-Haq Banday, Nissar Ahmad Ganie (Suppliers), Proprietor M/S A.N Traders, Seer Hamdan Anantnag, Shri Ahsan-ul-Haq Banday, Proprietor M/S B.N Traders, Srinagar, Shri Farooq Ahmad Malik of M/S Space Engineers Consortium and State Engineers Cooperative Ltd, and other suppliers. These officials are alleged to have misappropriated government money by purchase of material without inviting tenders on highly exorbitant rates from favourite suppliers thereby causing a loss of Rs.93.14 lakhs to the state exchequer during 2005-06.
The investigation of the case established that the officials of R&B division Qazigund in furtherance of a criminal conspiracy with the former Chief Engineer, R&B Kashmir and their favourite suppliers had effected purchases of Flournite Concrete Hardner, Quick Setting Powder and M.S Pipes in Qazigund division during 2005-06 without going through the competitive bidding and observation of codal requirements. Supply orders were placed with the suppliers for purchase of Flournite Concrete Hardner at very exorbitant rates compared to the prevailing market rates. In this way the accused engineers of R&B Qazigund division in league with the suppliers have caused a loss of Rs.56,60,338 to the state exchequer.
In another case the accused officials of the Khanabal division in furtherance of a criminal conspiracy had made purchases of Flournite concrete Hardner and other items without going inviting tenders and in gross violation of codal formalities. Investigation revealed that these accused officials purchased Flournite Concrete Hardner from M/S A.N Traders, Seer Hamdan, Anantnag causing a loss of RS.3,88,500 to the state exchequer While in another purchase from a different dealer the state suffered a loss of Rs.6,73,165 and in yet another purchase made at exorbitant rates a loss of Rs.54,61,668 was caused to the government. Thus the total loss to the state exchequer caused by this exorbitant purchase by Khanabal Division comes to Rs.36,53,872. The investigations have established that former Chief Engineer had a personal interest in the supplier firms and had allotted large sums to Qazigund and Khanabal divisions to facilitate this illegal purchase on exorbitant rates. After accord of sanction for prosecution the challan of the case was produced in the court of law.
