| HC dismisses Forest Contractor’s petition | | | Early Times Reporter Jammu | June 17 Justice JP Singh of J&K High Court Jammu Wing today dismissed the appeal of the forest contractor as the similar petition is already pending before the One Man Forest Authority. Dismissing the petition filed by the forest contractor seeking direction for releasing the cost of timber lying within the demarcated forest to the tune of over Rs 5.41 crore, Justice Singh observed that petitioner has already lodged a claim for the recovery of cost of timber lying in the demarcated forest and at the sale points, before One Man Forest Authority, which is seized of the matter as to the entitlement or otherwise of the petitioner to the amount claimed in the petition. The petition was filed by Anoop Kuthalia filed through Adv DS Thakur. Justice Singh, after hearing Adv DS Thakur appearing for the petitioner and Advocate General AH Naik appearing for the State and Ors and also referring to the earlier judgment of the petition filed by the petitioner, further observed that the petitioner cannot seek the same relief which he had sought before the One Man Forest Authority. Court finds petition as misconceived and is accordingly dismissed. JNF |
