HC stays SAC recommendation against Secretary Sports

Vacation Judge of J&K High Court Jammu wing Justice Mohammed Yaqoob Mir today stayed the recommendation of State Accountability Commission (SAC) whereby the Commission recommended appropriate punishment u/s 30 of J&K Civil Services (Classification, Control & Appeal) Rules 1956 against Ravinder Gupta, the then Secretary Sport, Council.
In a petition seeking quashment of recommendation of SAC, Justice Mir, after hearing Adv Sunil Sethi appearing for the petitioner, dictated this order in open Court and issued notice to respondents including the Commission returnable within four weeks and in the meanwhile stayed the recommendations.
The contractor in a complaint filed in the SAC had alleged that Secretary Sport Council Ravinder Gupta has stopped the payment on flimsy grounds by projecting falsely that the work was not executed in accordance with the requirements. SAC while disposing off the complaint, recommended appropriate punishment against the officer, which was challenged by the petitioner and stayed by the High Court today. JNF
