| Court rejects bail application of cop accused of rape | | | Early Times Reporter Jammu | June 18 Duty Magistrate, Jammu Archana Charka today rejected the bail application of a Cop arrested in much publicized rape case in police quarters. Applicant Shabir Ahmed serving in the J&K Police Department in District Special Branch Jammu filed this bail application through Adv AK Sawhney in which it has been submitted that a false case has been registered against the applicant by police station Gandhi Nagar Jammu and has been arrested in the said case. It has been alleged that prosecutrix is being used to trap him. According to the Adv AK Sawhney the applicant has unblemished service career and has been active in curbing militants and anti-national activities and has been awarded so many times for his distinguished service and has killed more than 170 militants. On the other hand, CPO Mr. MA Manhas appearing for the state submitted that offence u/s 363, 366-A, 342, 376, 109 RPC is very grave and serious in nature and having so many medals in his career does not mean that the applicant/accused has license to do such heinous offence. He opposed the bail application on the plea that investigation was still going. The Duty Magistrate while considering the bail application and report of the police said that on June 1, 2008, prosecutrix had lodged a report with P/S Gandhi Nagar Jammu that she is a student and was going to school for getting certificate at Sunderbani in Bus. One person namely Moulvi Ashraf met her with whom she came to Jammu and stayed in a hotel. Moulvi went away from the hotel. Ramesh and Shabir Ahmed took her to Gulshan Ground quarters (police lines). Shabir Ahmed committed rape upon her. From the crux of the report submitted by the agency, The court further observed that the persons responsible to safeguard the life, liberty and freedom of common man are involved in a heinous crime where the victim is alleged to be made to believe that she will be provided enough protection and security, the culprit who attempted to outrage her modesty will be brought to book, instead the persons extending such helping hand themselves adopted posture of demons and committed rape on her. As such there is no reason or occasion to make this court believe that such person deserves any leniency and accordingly the bail application is dismissed. JNF |
