| HC issues notice to respondents; directs considering petitioner’s representation | | | Early Times Reporter Jammu | June 20 In a petition filed by Assistant Executive Engineer, Irrigation and Flood Control Department seeking promotion to the post of Executive Engineer in SC category, Vacation Judge of J&K High Court Jammu Wing, Justice, Mohammed Yaqoob Mir, has issued notice to the respondents returnable within three weeks and in the meanwhile directed the respondents to consider the representation of the petitioner as it is said to have been made strictly in accordance with reservation rules coupled with seniority. The petition has been filed by Dewan Chand presently AEE Irrigation and Flood Control Department through Sr. Adv MK Bhardwaj with Adv CS Azad. During the course of arguments, the petitioner’s advocates submitted that Government has issued order No 229-PW of 2008 dated May 16, 2008 where under 12 AEEs have been given promotion as Executive Engineers but quite surprisingly not even single person from SC category has been taken though at least two vacancies are available as per reservation rules for promotion to the post of Executive Engineers. The petitioner immediately represented against the said order before the respondents clearly making out that his right has been violated by not considering his case for promotion under the rules of reservation. The respondents are under an obligation to give promotion to the candidate next in the seniority list in the SC category. The petitioner on the background and facts of the case has filed this petition seeking direction to the respondents to promote the petitioner on the post of Executive Engineer in the SC category.
