Court rejected bail of accused involved in gang rape case

3rd Additional Sessions Judge Jammu (Vacation Sessions Judge) Mr. Sanjay Gupta today rejected the bail application of Mohammed Aslam involved in a gang rape.
According to the case dairy on April 29, 2008 at about 5.30 pm the prosecutrix was going to Bazaar for purchasing, when she reached shop of Fakar Din, accused persons namely Mohd Yousaf, Mohd Aslam and Liaqat Ali forcibly took her in a nearby room and forcibly committed rape upon her. After committing the rape, all the accused fled away from the spot. FIR was registered u/s 376/341/34 RPC. During the course of investigation, statements of witness and prosecutrix were recorded and the accused Mohammed Aslam was arrested on May 3, 2008.
Court, after hearing APP GS Charka appearing for the state and the counsel for the accused, observed that keeping in view the whole circumstances of the case and law pronounced by J&K High Court, Court is of the firm opinion that this is not a fit case for grant of bail at this stage and hence the bail application is rejected.
