Floor Test is the Best option

The political uncertainty and high voltage drama continues in Maharashtra even after hush-,hush swearing in ceremony at Rashtrapati Bhavan on Saturday early morning in which Davendra Fadnavis was administered oath as the chief minister and Ajit Pawar of NCP as the deputy chief minister. All this happened so swiftly and hurriedly thus stunned one and all. The SS, NCP and congress combine opposed the formation of the government in this way and they questioned the manner and swiftness with which the state governor administered the oath of office to CM and deputy CM when the tripartite coalition of SS, NCP and congress was about to stake claim of government formation. But suddenly the governor BS Koshyari allowed the BJP and Ajit pawar faction of NCP to take oath in which Fadnavis and Ajit Pawar were given oath. It was no less than an overnight coup and this was a surprise to all including the SS,NCP and congress and they equated this with the murder of democracy and likened it with the constitutional impropriety .They said that it is against the precedents and past practices and is illegal. .The governor has asked Fadnavis to show the majority on the floor of the house on 30th of November. .The SS, NCP and congress are questioning the time gap for the floor test. They allege horse trading and the use of money and muscle power for showing the majority and thus they demand the holding the floor test within twenty four hours. The power tussle of Maharashtra has reached to the parliament and the supreme court of India thanks to the filing of the write petition in the top court by the SS, NCP and congress. Neither the parliament of India nor the supreme court and nor the governors house are the proper forum for the testing of majority. The proper place for the ascertaining the majority is the floor of the assembly and therefore floor test is the best and the only viable option to test the majority .This principle is based on the past precedents and practices. S.R Bomi case is clear on this and it was held that governors house is not the proper and right place to prove the majority. The trio of SS, NCP and congress has taken the case of government formation to supreme court and they are praying for holding of the floor test as quickly as possible as their contention is that upto 30th November there is much time and scope for political maneuvering and muscle power as well as the use of money power to influence the legislators. Therefore floor test should be held in twenty four hours and the tripartite alliance of SS, NCP and congress should be given a chance to show its strength.The combine on Saturday night filed a petition in the supreme court seeking quashing of Maharashtra governors decision to swear in BJPs Davendra Fadnavis as chief minister and demanded an immediate floor test to avoid further horse trading and sought urgent hearing on Sunday. The top court asked the solicitor General Tushar Mehta to place before it tomorrow i.e Monday morning letter of governor recommending revocation of presidents rule and issued notice to centre and others .The supreme court on Monday reserved the decision to Tuesday. Now the ball is in the hands of the top court and it is hoped that the apex court will give its verdict independently and a floor test will be held in a short time as November 30th is very far so for this issue is concerned. It is also hoped that the governor will see the intricacies of the situation and call for holding the floor test very soon to seal the chances of horse trading and the use of muscle power and money power in attracting legislators .The supreme court is about to decide this significant case on Wednesday and with the supreme court ruling and its implementation the power tussle in Maharashtra will stop and a viable government will be formed. It will be very interesting to see will the Fadnavis government pass or fail in the floor test. Now all eyes are set on the supreme court and the holding of the floor test to know the majority. Thus the floor test is the best and the only option in this case. Let us hope that the stalemate and political uncertainty will cease with the Supreme Court decision and consequent floor test. In the meantime SS, preparing to assume the CM's post after 20 years has been left in lurch and high and dry. With the Supreme Court decision tomorrow it will be clear when will the floor test be held and subsequently whose government will be formed in the state and this will also end the power tussle in the state. Let us hope for the best.
