| HC stays selection of Registrar of Medicines | | 2 yr service for appointment of Registrar challenged | | Early Times Reporter Jammu | June 23 In a petition challenging two years service as Assistant Surgeon for appointment as Registrars in GMC Jammu, Vacation Judge of J&K High Court Jammu Wing Justice Mohd Yaqoob Mir, after hearing Advocates Yasser Ejaz Tak and Rakesh Sharma appearing for the petitioners, stayed the selection of Registrarship on tenure basis concerning the discipline of Medicine and also issued notice to the State of J&K and Others. Dr. Rajesh Kumar and Dr. Tejinder Kumar in their petitions challenged the advertisement notice issued by Principal GMC Jammu on May 8, 2008 invited applications from the in-service J&K Medical (Gazetted) Services doctors who have put in at least two years service as Assistant Surgeon for their deployment/ appointment as Registrar in GMC Jammu. In the petition it has been submitted that the petitioners completed their MBBS in the year 2000 and post-graduation in the discipline of Medicine completed in the year 2007 and 2006 respectively and presently working as Assistant Surgeon in the Health Department of State. During the course of arguments Advocates Yasser Ejaz Tak and Rakesh Sharma appearing for the petitioners submitted that the process for appointment of Registrars on tenure basis prescribed the condition of experience of one year and further submitted that the applications as filed by the petitioners have not been processed which resulted depriving petitioners to compete for registrarship and also referred and advertisement notice dated October 13, 2007 issued by the Principal Govt Medical College Srinagar whereby no such condition of Govt service was provided and also prayed for quashing the advertisement notice dated May 8, 2008 issued by Principal GMC Jammu to the extent it provides for the eligibility criteria of two years Govt service for appointment as Registrar in GMC Jammu. Court after considering the arguments of the counsels appearing for the petitioners observed that submission at this stage appears to be of prevailing force, hence the selection of registrarship on tenure basis concerning the discipline of Medicine shall remain stayed.
