| FIR in Canal Power House against Ravish Trehan and others | | HC stayed further proceedings in the matter | | Jammu, September, 01:- Justice Nirmal Singh of J&K High Court Jammu Wing in a much publicized Canal Power House Case in which the Vigilance Organization has registered an FIR No 29/2003 against the then Chief Secretary Mr. Ashok Jaitly, Ravish Trehan of M/S Trehan Industries and Mr. Ashok Kumar a consultant, has allowed four weeks time to file objections to respondents and in the meanwhile further proceedings shall remain stayed.
HC stayed the further proceedings in a writ petition filed by Mr. Ravish Trehan Vs State of Jammu and Kashmir through Commission of Vigilance and other, seeking quashment of FIR 29/2003 registered by P/S Vigilance Organization Jammu. Advocate Vipin Gandotra appearing for the petitioner submitted that in terms of Govt orders No: 34-PDD of 2002 and 35-PDD of 2002, Canal Power of was handed over to the petitioner’s concern M/S Trehan Industries for renovation. Vide Govt order 97-PDD of 2003; a committee was constituted for determining “estimates of the work done by Trehan Industries in the Power House”. According to advocate Vipin Gandotra the Govt order No 100-PDD of 2003 dated May 31, 2003 superseded Govt order No 34-PDD of 2002 and directed take over Canal Power House by the J&K PDC. On October 11, 2003 FIR NO 29/2003 was registered by the Vigilance Organization against the then Chief Secretary Ashok Jaitly, Ravish Trehan and Ashok Kumar a consultant u/s 120-B r/w section 420/201 RPC r/w 5(1)(d) r/w section 5(2) of J&K PC Act 2006 BK. Advocate further submitted that in another petition filed by Ashok Kumar consultant, the Single Judge of the state High Court quashed FIR 29/2003 in so far as the said petitioners was concerned and seeking quashment of FIR on the same ground. |
