Crime Branch Jammu has produced challan against Mohd Maqbool War S/o Ali Mohd War R/o Rohama Baramulla and Gh. Mohd S/o Ab. Aziz R/o Pamposh Colony Narwal, Jammu for fraud withdrawal of Rs 9000 from Estate Department.
Brief facts of the case are that a case was registered on the report of Mohd Aslam Kohli candidate of BJP Halqa Surankote alleging therein that he was candidate of BJP Halqa Surankote in the election. As per the Govt. rule every candidate can reside in a Govt rental house in Jammu city. He is residing in Jammu city at a rented house of Mohd Aslam Shiekh S/o Wali Mohd R/o Surankote presently Jammu. According to the Govt. rule when he approached in the Estates Department in connection with collecting rent of the house. He became very strange when he come to know that he was already collected rent of the house. On enquiry it is found that Haji Gh Rasool Sofi owner of the Hotel Mughal Darbar Residency Road Jammu had filed an affidavit in the Estate Department that he was given one room of Hotel to Mohd Aslam Kohli since 1996 and is continuously residing in that room. On the basis of the affidavit the Estate Department had paid Rs 9000/ through Bank draft which later on encased, the amount from the bank. In this way the Estate Department has handover the amount to one Sh.Mohd Maqbool War against the rule Mohd Maqbool War political worker and Gh. Mohd Tantry committed the offence after hatching criminal conspiracy crime , Upon this above case registered in P/s Crime Branch Jammu.
During the course of investigation statements of witnesses were recorded U/s 161/Cr.Pc and records such as original affidavits , original bill, accommodation lists, original Bank Drafts related to the case were seized from the Estate Department as well as Bank concerned. The specimen signature of owner of the Hotel Mughal Darbar Jammu and other concerned were obtained and accordingly got caparisoned through ESL. From the investigation conducted by this agency, it was substantiated that Mohd Maqbool War, who was putting up in Hotel Mughal Darbar in Jammu on rent basis, as a political Candidate and during his stay in Hotel, the rent of Rs 9000 was over due to him, when the owner of the Hotel Mughal Darbar, Residency Road, Jammu asked for the rent the accused prepare fake affidavit on the behalf of the owner of Mughal Darbar Hotel, saying there in that mood Aslam Kohli a political worker, who was also a tenant in the same Hotel on monthly rent of Rs 1500. Per month, the said tenant has been putting up along with his family in the Hotel and is likely to vacate the same that the tenant belongs to poonch and is not putting up there because of militancy. The accused Mohd Maqbool War presently the said affidavit before the authorities personating himself as Mohd Aslam Kohli, on the said affidavit the Estate Department released the cheque of Rs 9000. in favour of the accused which was later on en-cashed by him. Moreover the accused Gh. Mohd Tantry has wrongly identified the Mohd War as Mohd Aslam Kohli before the Estate Department, resulting which Estate Department release the cheque in the favour of accused person, bereaving him as Mohd Aslam Kohli So the said Gg. Mohd Tantry is equally involved in the whole conspiracy of the instant case. Both these accused persons have been challenged in the competent Court of Law for Judicial determination. |
