Capt Megha Razdan’s suicide case takes new turn
Court sets aside order of committal court; remands case for further proceedings

Capt Megha Razdan’s suicide mystery took a new turn today when Principal Sessions Judge Jammu JR Kotwal set aside the order passed by the Committal Court and remanded back the case for further proceedings. The husband of deceased, Capt Chaitanya Bhatwadkar, was allegedly involved and challan was presented u/s 306/498-A RPC by CJM Jammu to this Court for trial of case as section 306 (abetment to suicide) is exclusively triable by the Court of Session.
After hearing Public Prosecutor EA Tak appearing for the State and Adv Sunil Sethi appearing for the accused who was produced in the Court in custody, Principal Sessions Judge observed that undisputedly the accused at the time of alleged occurrence was army personnel subject to the Army Act. Offences u/s 306/498-A RPC for which the accused has been challaned fall within the category of "Civil Offences" as defined u/s 3 (ii) of Act to which sections 69 and 70 of the Act would apply. The committal court has, thus, fallen into error by passing the committal order without first complying with the provisions of section 549 Cr PC r/w relevant rules on the subject. The order, thus, suffers from illegality and does not sustain. The order passed by the Committal Court is, therefore, set-aside and the case is remanded back for proceedings as observed above.
According to the police case that Captain Chatanya Bhatwadekar husband of deceased Capt Mega Razdan who was found hanging on July 1, 2007 at Kunjwani Army Quarters and police initiated investigation in the mysterious death and registered a case U/Ss 306 (abetment) & 498-A (cruelty) RPC on April 1, 2008 and after completion of the investigation police on May 30, 2008 presented challan against the accused Capt Chaitanya who is presently in judicial custody.
