| HC stays appointment of lecturer | | | Early Times Reporter

Justice Sunil Hali of J&K High Court Jammu Wing in a petition challenging the appointment of a private respondent as lecturer 10+2 in chemistry under ALC category, has stayed the appointment of private respondent in the ALC Category and issued notice to Commissioner/ secretary School Education, Secretary J&K Public Service Commission and Tahira Naqvi (private respondent) returnable within 3 weeks and clarified that the stay order shall be subject to the objections to the other side.
In the petition filed by Zaheer Beg through Adv Shahzad Azeem challenging the selection/ appointment of Tahira Naqvi under ALC category to the post of lecturer 10+2 in chemistry compliance seeking quashment of the same on various ground including that against the notification issued by the PSC on January 17, 2006 for the post of lecturer 10+2 in chemistry no post under ALC category was reserved. The selection of private respondent is against law and fact as such does not sustain in the eyes of law is liable to be quashed as the notification issued by the PSC on January 17, 2006 there was no post under the reserved category ALC and vide the selection order issued by the PSC on June 13, 2008, the private respondent is shown to have been under ALC category and seeking quashment of the order.
