| HC rejects petitioner’s claim | | Controversy over shifting of dispensary allegedly at the behest of MLA | | Early Times Reporter Jammu | July 5 Justice JP Singh of J&K High Court Jammu Wing in a petition filed by Public Panchayat Halqa Kanthi against the shifting of ISM Dispensary allegedly at the behest of MLA Ajaz Ahmed MLA Gool Arnas, has rejected the claim of the petitioners. In the petition it was alleged that respondents sanctioned and started ISM Dispensary at village Bhallar, District Udhampur in the 1964-65 and the dispensary had been serving more than 6000 people of the area but at the behest of MLA Gool, Arnas, shifted the dispensary to Village Thiloo. According to the respondents it was decided that ISM dispensary had been sanctioned for village Thillo and had accordingly being functioning. But during the militancy in the area, the dispensary had to be shifted temporarily from Thillo to Kanthi. Respondents have specifically denied that the order had been issued at the behest of MLA concerned. Justice Singh after hearing both the sides observed that the plea projected by the petitioners that ISM dispensary should be at Bhallar rather than Thillo because its setting-up at Bhallar would cater to the need of more people than it would serve at Thillo, is a question which cannot be adjudicated upon by this Court in exercise of its extra ordinary writ jurisdiction, for it lies entirely with in the province of the executive to consider as to whether would it be appropriate to set-up an ISM dispensary to cater to the needs of the people of the area.
