Court sent six OGWs to 15 days judicial remand

JAMMU, Feb 22: In the Ban Toll Plaza militant attack on January 31 in which three Pak militants of JeM outfit were gunned down, Special Judge NIA Court Subash C Gupta granted 15 days judicial remand of ix OGWs namely Sameer Ahmed Dar, Asif Ahmed Malik, Sartaj Ahmed Mantoo, all residents of Kakapora-Pulwama, Suheel Javid alias Sohail Lone, Zahoor Ahmed Khan and Suhaib Manzoor.
This order has been passed in an application has been filed by Rakesh Balwal- CIO, NIA, Jammu seeking shifting of above referred accused from police cusotdy to judicial cusotdy for 30 days, on remand.
The Court on perusal of the CD file said that it transpired on 31-1-2020 and 09-02-2020 the above named accused were arrested in Case FIR No;45/2020 of P/S Nagrota for the commission of offences under sections 307/120-B/121/122 & 123 IPC, 7/25 ,26,27 Arms Act ,16 & 18 UA(P) Act.
It can further be gathered that investigation of the case was handed over to NIA by the Ministry of Home Affairs, Govt of India. It further becomes evident that consequent there upon, NIA, Jammu registered the above titled Case FIR. Earlier, this court ordered the transfer of the relevant record of CD file, Case Property & custody. Today, the accused have been got medically examined from the Police Hospital, DPL Jammu.
The Court observed that keeping in view the facts and the circumstances of the case, gravity and heinousness of the crime as involved in the present matter, submissions made by the CIO of the NIA and the stage of the investigation of the case, the court is of the considered opinion that remanding the accused to judicial custody as prayed by the NIA through the medium of the present application is imperative for completion of the ongoing investigation.
