| Rights panel recommends exgratia to kin of 4 killed in custody | | | Early Times Reporter Jammu | July 10 Jammu and Kashmir State Human Rights Commission (SHRC) today recommended that the government pay Rs 2 lakh each to the next of kin of four persons killed in custody of security forces in Poonch and Rajouri districts. Disposing off a petition filed by widows of three men allegedly killed in army custody, SHRC action chairman H U Bhat recommended payment of exgratia relief of Rs 2 lakh each to the next of kin of the deceased. According to the complaint filed by Sakina Bi, Gulzar Bi and Shamim Akhter, the victims were arrested by army from their village Dehri Dabsi in Poonch district in June 2002. The three men were then allegedly shot dead in custody by army personnel and dubbed as militants killed in an "encounter". The SHRC chairman said the police has shown professionalism in establishing murder during a fake encounter but have failed to arrange the presence of the accused before the court of law. "The case has been already established and it is solicited to the government of Jammu and Kashmir that required steps may be taken for ensuring their (accused) successful prosecution before a court of law," Bhat added. In another case, the commission held four policemen guilty of killing a civilian, Showket Ali in custody and asked the state to register a case of murder against the cops. The commission, which had taken suo moto cognizance of the death of Showkat Ali in February last year, held the then SHO, investigating officer Gyan Singh and constables Mohammad Razzak and Tassaduq Hussain responsible for the death. "A case of murder should be registered against the policemen and they should be prosecuted for the custodial death of Showket Ali," it added. The commission said that half the amount should be charged from the accused police personnel, which includes Rs 35,000 each from the then SHO and the investigating officer and Rs 15,000 each to be recovered from the two constables. The police in its report had pleaded that the accused was arrested in connection with a case and died of cardiac arrest when he was confronted with irrefutable evidence. The cops also deny that the deceased was subjected to torture during the questioning. |
