Court rejects bail application of 4 accused involved in attempt to murder case

Jammu July 11- Chief Judicial Magistrate Reasi, Madan Lal today rejected bail application of four accused involved in attempt to murder case and seriously injuring the victims.
While rejecting bail applications of all the accused persons, CJM, after hearing Adv Ajay Nanda appearing for the petitioner and Sr .PO Rajesh Bakshi appearing for the State, observed that injured Sanjay Kumar is still struggling for life in the Hospital and his statement is yet to be recorded. Keeping in view the gravity of the offence and severity of the punishment in the aforesaid offences, accused persons do not deserve the concession of bail at this stage hence the applications are rejected
The police report and objections filed by Sr. Prosecuting Officer Rajesh Bakshi, reveals that on June 14, 2008 complainant Madan Lal lodged a written report in P/S Katra submitting therein that complainant's son Sanjay Kumar and son-in-law Makhan and servant Pawan Kumar, who were returning to their home after closing their shop at 9 pm and when they reached Masjid Latori, accused persons namely Sohan r/o Kundarian, Joyti of the same village were equipped with sharp edged weapons (TOKA) along with other persons intercepted them with criminal intention and attacked upon the victims causing grievous injuries. On raising hue and cry the accused persons fled away leaving the injured on the road side. All the three injured were shifted to Katra Hospital, a report u/s 307/323/341/34 RPC r/w section 4/25 Arms Act was registered. The victims were not in a position to get their statements recorded and were referred to GMC Jammu. Injured Sanjay Kumar was referred to Amritsar for treatment but till date the statement of injured Sanjay Kumar could not be recorded. Victim Pawan Kumar and Makhan have disclosed that Mohd Rafi alias Sethi r/o Kundarian, Joginder Kumar were also involved in the crime. (JNF)
