Chief Judicial Magistrate Reasi, Madan Lal today rejected the bail application of Krishan Chand and Pritam Singh resident of village Dhanour Tehsil Mahore District Reasi who were allegedly involved in a rape case.
According to the police case on June 3, 2008 the complainant along with her younger sister had gone to jungle for grazing their cattle. Younger sister of the complainant was sitting under shady tree and slept there, in the meanwhile at about 1. 00 PM the accused persons namely Krishan Singh s/ Inder Singh and Pritam Sing s/o Lalman r/o Dhanour, suddenly appeared and accused Krishan Singh caught hold and wrapped the mouth with dupatta while another accused Pritam Singh caught hold her hands and both the accused forcibly lifted the complainant and took her near the cave and forcibly committed the rape. The complainant fell unconscious and in the meantime her sister woke-up, and found the victim absent from there and informed the father. The accused ran away from the scene and on June 4, 2008 complaint was lodged with the police and police registered a case u/s 376 RPC and started investigation and arrested both the accused.
CJM, after hearing Sr PO Mr. Rajesh Bakshi appearing for the state and Adv VK Sharma appearing for the accused persons and also going through the file, observed that the matter in hand clearly indicates that alleged accused persons have committed rape on the helpless woman and are allegedly involvedin a heinous offence, the question of giving concession of bail to the accused persons at this stage does not arise and thus the bail application is rejected.
