Justice Nirmal Singh of J&K High Court Jammu Wing has modified the order of October 31, 2007, whereby selection/appointment of five private respondents was stayed, to the extent that three private respondents, who moved application that they possessed the diploma in cooperative training, shall be produced before the competent authority who will scrutinize the same and in case these held to be valid in accordance with the rules, then the said private respondents would be allowed to join in pursuance to their selection made against the post of junior supervisor/ sub-auditor, if there is no other legal impediment. This significant order was passed by the High Court in a petition filed by one Prabha Gupta through Adv Surinder Kour in which the petitioner submitted that the qualification for the post of Junior Supervisor/ Sub-Auditor is 10+2 with diploma in Cooperative training and the private respondents who have been selected do not possess the diploma in cooperative training and thus were not entitled for appointment. Court on October 31, 2007 stayed the appointment of five private respondents. Upon this the High Court modified the order of October 31, 2007 and directed authorities to scrutinize the diploma of three private respondents. JNF |
