Marriage out of biradary couple harassed by the relatives
HC directs SSP Poonch to ensure no one interferes in their married life

Justice JP Singh of J&K High Court Jammu Wing in a petition filed by Khazeena Fatima w/o Nishat Ahmed of village Senai Surankote, who appeared in person along with her two years old daughter, issued notice to the respondents and in the meanwhile directed SSP Poonch and Dy SP Surankote to ensure that no one interferes in the married life of the petitioner and Nishat Ahmed her husband until next date of hearing.
In the petition filed through Adv Anil Sethi, in which the petitioner appeared in person, it has been submitted that she got married to Nishat Ahmed and Nikahnama has been executed on November 8, 2003. Whereas the Nishat Ahmed husband of the petitioner belongs to different sect of Muslim and is not member of the Biradary of the petitioner and therefore, marriage was not taken well by the accused persons who are the relatives of the petitioner. The petitioner has a daughter of two years of age; the relatives of the petitioner have been continuously harassing and victimizing the petitioner and her husband. They made various physical assaults on the petitioner and her husband with the intention to take away the petitioner forcibly from the lawful custody of her husband and further handover her to a person of their choice. This is not only un-Islamic but anti-thesis of civilized society as well. The petitioner is a matured lady has taken the decision to her marriage with Nishat Ahmed voluntarily without any force or coercion. The relatives of the petitioner have no authority in law to indulge in case of vandalism, criminal, victimization, harassment and physical torture to the petitioner and her husband and seeking protection.
Upon this the Court directed SSP Poonch to ensure the protection of the petitioner and her husband. JNF
