| HC dismisses petition on purchase of BP Jackets | | | Early Times Reporter Jammu | Aug 14
Justice JP Singh of J&K High Court Jammu Wing has dismissed a petition filed by M/S Laggar Industries Limited seeking quashment of State Level Purchase Committee's decision of January 3, 2002 whereby the sample of the petitioner company for supply of BP Jackets and BP Patkhas had been rejected. The petitioner company in its petition seeking direction to the respondents to allot it the contract for supply of BP Jackets and BP Patkhas alleged that the respondents may not conduct ballistic test in terms of guidelines issued by the Ministry of Home Affairs on November 8, 2000 while considering its samples, the petitioner had earlier also filed a petition in the year 2001 which was disposed off on November 8, 2001 with a direction to respondents to examine the claim of the petitioner. Justice JP Singh, after hearing Adv Vikas Magotra appearing for the petitioner company, Pratibha Mahajan Advocate appearing for Union of India and Director General Bureau of Police Research and Development, Government of India, Adv SS Ahmed appearing for private respondent No 4, observed that petitioner has not placed anything on record to contradict the stand taken by the DGP in his affidavit. In the absence of anything having been placed on record by the petitioner which may support the petitioner's contention and contradict the stand taken by the official respondents, Court do not find any merit of the petitioner's submissions that the respondents had not conducted the ballistic test. Counsel of the petitioner's submissions is found to be without any merit which is accordingly rejected. With these observations, the Court dismissed the petition. JNF |
