Justice Virender Singh of J&K High Court Jammu Wing disposed off three appeals filed by the New India Assurance Company limited against the awards of Motor Accident Claim Tribunal. MACT had awarded Rs 2, 75, 000 in favour of parents of deceased Ranjeet Singh, Rs 2, 30, 000 in favour of parents of deceased Suresh Singh and Rs 5, 26, 616 in favour of parents and wife of deceased Rajinder Singh along with 9% interest. Justice Virender Singh, after hearing battery of lawyers, observed that two appeals filed by New India Assurance Company against the award of compensation granted by the tribunal does not call for any modification and deserves to be dismissed. Regarding the third appeal, Justice Singh said that the court is of the consider view that the loss, as assessed by the Tribunal, is appropriate and does not call for any reduction. The court also observed that the Motor Vehicles Act is aimed at achievement of welfare of the victim and in case of death of his depends. Court do not find any justification to reduce the interest and maintained that the interest @ 9% PA is appropriate keeping in view the peculiar facts and circumstances of three cases and accordingly dismissed all the three appeals having no merits.
