| HC stays detachment of Medical Officer ISM | | | Early Times Reporter

Justice YP Nargotra of J&K High Court Jammu has issued notice to the Commissioner/Secretary Health & Medical Education Dept, Director ISM J&K and Medical Supt Government Ayurvedic Hospital Jammu and in the meanwhile stayed the detachment order of the petitioner Dr. Taran Singh, Medical Officer ISM subject to condition that the post from which he has been detached exists on the cadre strength of the department against which he stood adjusted. Court clarified that this order is, however, subject to objections from other side.
The petitioner Dr. Tarun Singh who appeared in person submitted that he is working as Medical Officer in the Dept of ISM for almost two decades and is facing stagnation against aforesaid post and despite the fact that the petitioner is fully eligible, rather is only eligible candidate, for the post of Medical Supt, yet the petitioner till date has not been considered for the post of Medical Supt vide order dated April 15, 2008 passed by the Director ISM. The petitioner, who was awaiting orders of his posting, was transferred to GMC Jammu in the interest of administration. The petitioner joined and started discharging his duties and in the meantime the government vide order dated July 17, 2008 ordered that all Government employees both Gazatted or non-gazatted ,who were attached with various officers, shall be detached immediately and relieved to report to their original place of posting. This order was challenged by the petitioner; Court after hearing the petitioner stayed the impugned order. JNF |
