| Major facing trial in wife's murder case | | HC directs speedy disposal of the case | | Early Times Reporter Jammu | Aug 23
Accused Major Viveky Rai, who short dead his wife Sarita in the month November, 2003 and is presently lodged in the District Jail Jammu from the date of occurrence, has filed an application in the state High Court seeking stay of the transfer of trial from Jammu Court to newly created Samba District. Justice Sunil Hali of Jammu and Kashmir High Court, after hearing father of the petitioner Col Vishwa Nath Rai, observed that the grievance of the petitioner is that the case State Vs Viveky Rai was pending before 1st Additional Sessions Judge Jammu. In this case the arguments were concluded on April 28, 2008 and the case was fixed for judgment on May 15, 2008. In view of creation of new district, the case file has to be sent to Sessions Court Samba for disposal under law. Petitioner submitted that this matter has been heard by the 1st Additional Sessions Judge Jammu and he was only required to pass a final judgment in the case. Justice Hali further observed that Court find merit in the submissions made by the petitioner and directed that the file State Vs Viveky Rai, pending in the Court Sessions Judge Samba, be transferred to the court of 1st Additional Sessions Judge Jammu for final disposal. It is stated at the Bar that the file has not been sent to Sessions Judge Samba in view of prevailing turmoil in the state. In case file is with the Ist Additional Sessions Judge Jammu, he shall send a notice to Additional Public Prosecutor and dispose off the case in accordance with law. JNF |
