Court rejects bail of wife facing trial in husband's murder

JAMMU, Oct, 22: Additional Sessions Judge Doda Mehmood Ahmed Choudhary today rejected bail application of Shabina Begum, wife of Late Khursheed Ahmed of Qilla Mohalla, Bhaderwah facing trial in murder of her husband.
APP appearing for the UT strongly opposed the bail application and submitted that accused namely Shabina Begum is involved in a criminal case U/Ss 302/201 IPC which are cognizable as well as non-bailable and in the non-bailable offenses, accused cannot claims bail as a matter of right. That the offences committed by the accused person are exclusively trial-able by the Session Court and punishment prescribed under this Code shall be death or imprisonment for life and shall also be liable to fine.
Additional Sessions Judge Doda Mehmood Ahmed Choudhary after hearing both the sides in length observed that the accused prima-facie is involved in the offenses U/Ss 302/201 IPC, although, the charge is yet to be framed due to the reason that the Covid-19 Pandemic is spreading fast and the health advisories issued by the Government the petitioner/accused has not been produce before the Court. As such, I am hesitant to accept the preposition to hold for Counsel that the petitioner is entitled to concession of bail on the ground referred in the petition. I do not find any ground for release of accused on bail at this stage. —JNF
