Two Engineers sought HC intervention, got stay in posting

The fear factor prevailing among the government employees required to work in Kashmir Valley came to the fore today when two Engineers approached the state High Court seeking stay on their postings in Anantnag and Baramulla.
Justice Nirmal Singh of J&K High Court, Jammu Wing, today stayed the impugned order dated August 11, 2008 whereby the petitioners namely Vikas Gupta and Harvinder Singh Assistant Engineers were adjusted in Anantnag and Baramulla in Kashmir valley.
In the petition prepared by Advocate Nitin Bhasin, in which the petitioners appeared in person, sought quashment of Govt order dated August 11, 2008 whereby the petitioner Vikas Gupta has been adjusted as AE MID Anantnag and petitioner Harvinder Singh adjusted as AE MID Baramulla. The petitioners submitted that they were promoted on
December 31, 2007 as Assistant Engineer in the PHE and had joined in their own divisions. Thereafter vide Govt order June 5, 2008, the petitioners were again sent to Hydraulic Wing for further adjustments and in the meantime the government through another order of August 11, adjusted the petitioners in Anantnag and Baramulla.
The petitioners further submitted that the situation in Anantnag and Baramulla is worst and being the members of minority community their lives are not safe in these areas. Both these districts are interior districts of Kashmir valley, whereas employees working in the Srinagar city, belonging to the minority community, have been forced to leave the city. Even the processions of lakhs of people have raised anti-India and pro-Pak slogans. The petitioners alleged that even the judges of Subordinate Judiciary were threatened that too in Srinagar which is capital city and they too had to leave the city, more than 1000 employees including doctors, engineers have been forced to leave the city. The situation in the interior is worst, petitioners will loose their lives if they go there and there is threat to their lives.
The petitioners said that the right to life has been recognized as fundamental right of a citizen. The petitioners have come to know that two posts of Assistant Engineer are lying vacant in the Akhnoor Division where the petitioners can be adjusted and prayed for quashment of the Govt. order dated August 11, 2008.
Justice Nirmal Singh, after hearing petitioners who appeared in person, issued notice to state of J&K through Principal Secretary to Govt. PHE, I&FC Dept and Chief Engineer PHE Dept Jammu returnable within two weeks. In the meanwhile, subject to objections by the other side, order impugned No 326-PW (HYD) of 2008 dated August 11, 2008 qua the petitioners shall remain stayed.
