| HC issues directions to PSC to fill up vacant posts | | | Early Times Reporter Jammu | Aug 27
Justice YP Nargotra of J&K High Court, Jammu Wing, in a petition raising point whether a candidate in a wait-list has a right of consideration against the post falling vacant due to resignation of a selected candidate after joining on the post during the validity of the wait list panel, has issued notice to Commissioner Secretary Higher Education, J&K Public Service Commission and Principal Government Degree College Rajouri with the direction that in the meanwhile if any post has fallen vacant with the resignation of any candidate after joining the same shall not be filled-up in case the name of the petitioner falls in wait list which may come to be prepared by the Public Service Commission and ordered that objections shall be filed within two weeks. These notices and directions were passed in a petition filed by Safeena Javeed who was a candidate under RBA category in the selection process initiated for the post of lecturer in political science by the J&K Public Service Commission. There were three posts in the category available for selection and appointment and three candidates who made the grade have been selected and select-list was issued. In the select-list no candidate has been kept in wait-list, though in view of the provision contained Rule 57 of J&K PSC (Business & Procedure) Rules 1980, the Commission was required to prepare and issue a wait list also. The petitioner relies upon a judgment of Division Bench of J&K High Court titled Ghulam Ahmed Malik Vs State and Ors and seeking direction to PSC for preparing wait-list. Court, after considering the points raised by the petitioner, issued notice and directions regarding filling-up vacant post. JNF |
