| Husband and Mother-in-law of deceased in dowry death case | | Court granted bail after ten month of their arrest | | Jammu, September, 08:- Justice YP Nargotra of J&K High Court Jammu Wing has granted bail to Bhushan Singh and Kailash Devi, who are facing trial as under trial prisoners in dowry death case after ten months. According to the prosecution case deceased Ritu Devi was wife of Bhushan Singh accused and daughter-in-law of Makhan Singh and Kailash Devi. She allegedly committed suicide on October 21, 2005. The police after investigation registered FIR NO 218/2005 on October 28, 2005 against the accused for commission of offence u/s 306 and 498-A RPC (dowry death). All the three accused were arrested on October 30, 2005. After completion of the investigation charge-sheet for trial of the accused was filed and the accused are being tried in the Court of First Additional Sessions Judge Jammu. Father-in-law of the deceased has been admitted to bail on medical ground, the other two accused filed an application before the trial Court for bail, the trial Court has rejected the bail applications of accused. The petitioners (accused) have now moved to High Court for seeking bail. Justice YP Nargotra after hearing both the sides observed that taking into consideration the nature of offences and the fact that the accused have been facing trial as under-trial prisoners for the last about 10 months. When the statement of not even a single witness has been recorded, the accused deserves to granted bail and ordered that the accused be admitted to bail on their furnishing bail bonds to the tune of Rs 10,000 each to the satisfaction of Trial Court. The accused shall also undertake that they would regularly appear before the Trial Court for facing the trial and shall not directly or indirectly influence the prosecution evidence. |
