| Court stayed the pre-mature transfer of Naib-Tehsildar | | |
Jammu, September, 08:- Justice Nisar Ahmed Kakru of J&K High Court Jammu Wing today issued notice to Commissioner/ Secretary, Financial Commissioner Revenue, Deputy Commissioner Central and Deputy Commissioner Doda in petition filed by Naib-Tehsildar challenging his pre-mature transfer. Court further ordered until decision on the recommendation of Deputy Commissioner, there shall be status-quo in respect of the position of the petitioner.
In the petition filed through Advocate AM Malik submitted that petitioner is an Incharge Naib-Tehsildar/ Assistant Revenue Attorney with DC Doda. The petitioner resumed his duty on January 30, 2006 and within a span of seven months, the Deputy Commissioner Central on the instruction of Financial Commissioner Revenue issued the impugned transfer order on August 18, 2006, thereby transferring the petition prematurely as Incharge Naib-Tehsildar Gandoh. The petitioner has been subjected to the frequent transfers as the stay of the petitioner as Incharge Naib-Tehsildar as his previous place of posting at Marwah was for the period of only six months. It is further submitted in the petition that DC Doda on August 30, 2006 forwarded the representation of the petitioner to Financial Commissioner Revenue for modifying the transfer order so that the petitioner is allowed to continue at Doda. In the petition, the petitioner prayed for issuance a direction to respondents to modifying the impugned order on the basis of recommendations of DC Doda. |
