| HC stays JE’s transfer order; directs for maintaining status-quo | | | Early Times Reporter Jammu | Aug 28
Justice Nirmal Singh of J&K High, Court Jammu Wing, in a petition filed by JE challenging his frequent transfers, issued notice returnable within four weeks and in the meanwhile, subject to objections by the other side parties, stayed the order directing to maintain status-quo as it exists today. This order has been passed in a petition filed by TK Sharma in which the petitioner submitted that while he was serving as Junior Engineer at PHE Division Akhnoor, he came to be transferred to PHE Division-II Jammu vide order dated June 20, 2007 and within a period of one week the aforesaid order was modified and the petitioner was again transferred from Jammu to PHE Division Samba. The petitioner joined at PHE Division Samba and on May 13, 2008, the petitioner was again transferred from PHE Division Samba to Power Development Corporation Jammu. The petitioner submitted that respondent authorities have no power to send an employee to the corporation on deputation without his consent. The petitioner further submitted that due to frequent transfer orders, the petitioner has been mentally harassed and even the children of the petitioner are suffering. He further stated earlier when he was transferred from Akhnoor Jammu, he got admitted his children in Jammu but again he was transferred from Jammu to Samba where he shifted his family and now again he has been transferred to Jammu. He further submitted that these transfer orders have been passed by the respondents with a malafide intention. Court after hearing the petitioner in person directed to maintain status-quo. JNF |
