| Court rejects anticipatory bail to Jasrotia in Sunjwan land scam | | | Early Times Reporter Jammu | Aug 28
Additional Sessions Judge Jammu Mr. MA Choudhary today rejected anticipatory bail application, filed by one Fateh Singh Jasrotia one of the Director Sainik Cooperative Housing Society, Sainik Colony Jammu, allegedly involved in much publicized land scam along with Chairman, Vice-Chairman of society, on the ground that the Crime Branch was investigation the case. CPO Bhupinder Singh of Crime Branch Jammu, who was also present, submitted that an enquiry was conducted on receipt of the written complaint which was endorsed by Forest Magistrate Jammu and after enquiry a case under FIR NO 17/2008 was registered u/s 420,427, 120-B RPC at P/S Crime Branch Jammu and the case was under investigation. CPO further submitted that Custodial Interrogation of the accused in the case is required and prayed that the application be rejected. Upon this Additional Sessions Judge observed that the jurisdiction of this Court in the matters of anticipatory bails is limited to those offences only which are non-bailable and as such this Court cannot invoke the jurisdiction of considering the pre-arrest bail in those offences which are bailable in nature. The application for grant of bail does not lie and is rejected. The interim direction granted on August 22, 2008 is revoked forthwith. JNF |
