HC comes to rescue of aspiring Engineer

Justice JP Singh of J&K High Court Jammu Wing, in a petition seeking direction to the Board of Professional Entrance Examination to permit the petitioner to fill-up the form required for appearing in the Common Entrance Test for bachelor of engineering course, issued notice to State of J&K through Chief Secretary, Chairman BOPEE.
After hearing the petitioner in person, the Court ordered that in the meanwhile BOPEE, if approached, shall permit the petitioner to fill-up the form for appearing in the CET for the session 2008-2009 and in case found eligible, shall permit her to appear in the Entrance Test. Court further directed that the result of entrance test shall, however, be kept in a sealed cover. Appearance of the petitioner in the Common Entrance Test shall be subject to further orders.
These directions were passed in a petition filed by Rizwana Choudhary, seeking direction to the respondent to allow her to fill-up the form for the Common Entrance Test on the ground that her result was declared on May 23, 2008 as unfortunately on account of wrong assessment of her paper in mathematics, she did not secure sufficient marks. She therefore reappeared in the examination and was declared passed with D-1 Grade. The petitioner moved a representation before the Board of Entrance Examination for allowing her to take part in CET. The petitioner submitted that despite filling of representation for allowing her to participate in the test, the BOPEE has not acted in the matter.
Anil Sethi appearing for the petitioner submitted that in case the petitioner is not permitted to take part in the CET which was advertised vide notification dated May 27, 2008, the petitioner shall loose her crucial one year of her career. The Common Entrance Test has not been conducted till date on account of disruption of normal activities in Jammu Province because of Shri Amarnath land row protest. The petitioner prayed before the Court for issuance a direction to respondents to entertain the application of a petitioner for CET. JNF
