District & Sessions Judge Presiding Officer Motor Accident Claims Tribunal, Jammu, Jang Bhadur Singh Jamwal, in an accident claim petition, has decided the case of the petitioners after 21 years and awarded compensation to the tune of Rs 10, 38, 400 to the family of deceased Dr. D N Dhar. While deciding the claim petition Presiding Officer MACT observed that this claim petition speaks of despicable betrayal of justice delivering system which took 21 years to dispose off this petition which came to be presented before MACT at Srinagar seeking indulgence of Tribunal for grant of compensation on account of death of Dr. DN Dhar in a road accident on in 1987. According to the claim petition that on August 28, 1987 at about 9.30 am Dr. Durga Nath Dhar, Scientist in Indian Veterinary Institute, was walking on the left side of the road at Ram Munshi Bagh , Srinagar, when a car with a rash and negligent driving, went out of control and hit the deceased from the rear side causing head-injury. He was taken to Sher-e-Kashmir Institute of Medical Sciences, where he was operated upon and then shifted to Delhi and ultimately succumbed to his injuries at Shri Ganga Ram Hospital New Delhi on October 23, 1987. The Tribunal, after hearing both the sides, decided the claim petition after 21 years and awarded Rs 9, 98, 400 and further allowed Rs 25000 loss for taking deceased to Delhi for medical check up purposes and Rs 15000 as funeral expenses along with the interest @ 7.5% Per Annum. Tribunal ordered that out of the award amount Rs 1 lakh each be paid to daughter, two sons of the deceased and the rest of the amount be paid to the widow of the deceased. JNF |
