‘Asserting that the restoration of land to the Shri Amarnath Shrine Board is not negotiable and no body can dilute the stand on the issue’, the Bar Association, Jammu in a meeting held under the chairmanship of its president B S Slathia, reiterated that the ongoing agitation spearheaded by Sangarsh Samiti, would continue till restoration of land to the Shrine Board. The Bar association, which is already supporting the ongoing movement right from the day one, has appealed the people of Jammu to stand united with the Sangarsh Samiti. The Bar unanimously decided to urge the Sangarsh Samiti to also take up the issue of discrimination meted out to the people of the region during the last 60 years in all spheres at the hands of the Kashmir centric politicians which has emerged as a consensus during the ongoing agitation, besides the need for setting up delimitation commission. The Bar opined that the people of Jammu have not only emotional attachment to the demand of restoration of land but are legally justified to ask for its restoration as the same falls within the parameters of the constitutional guarantees in a secular state and maintained that there could be no comprise on it. Strongly criticizing the authorities for ordering arrest of innocent youth and a revered Saint under PSA, by ignoring the fact that they have been working for strengthening and upholding the National flag without disturbing communal harmony, the Bar association alleged that those raising anti-national slogans and burning the tricolor go scot free. Taking strong note of the arrest of innocent civilians and torture being administered to Them, while in police custody, the Bar Association has advised the authorities to strictly adhere to the principles laid down by the Apex Court judgment in D K Basu’s case ‘as the concept of third degree method is alien to the present day Indian legal system’. More so, the torture of innocent youths and civilians, while in custody or otherwise, who are democratically protesting for their genuine demands, is not only a serious offence in law but an act of ‘state terrorism’ which shall not tolerated at any cost, the Bar Association warned. The Association has urged the government to immediately withdraw cases including PSA lodged against the persons involved in the ongoing agitation to create a congenial atmosphere and show sincerity for holding peace in the area. Referring to the harassment at the hands of miscreants and anti-national elements to the Jammu based employees and posted in valley, the Bar Association has impressed upon the government not to compel these employees to join their field duties at various places in the valley till restoration of normalcy and conducive atmosphere in created there. The Association has also demanded a judicial probe into the circumstances leading to the forcible return of Jammu based employees to their homes and hearths. The Bar association has appealed to the Kashmir civil society to come forward and create congenial atmosphere where persons from different religions could live and work together as is the case with Jammu, where the civil society has always stood for it. |
