HC stays proceedings in bail application

JAMMU, Nov 30: The High Court of J&K at Jammu Bench comprising Justice Javed Iqbal Wani has passed a significant order in a petition filed by Bacchan Lal Son of Bhulla Ram R/o Ward no. 4 New Colony R S Pura Jammu father of victim/ injured namely Rakesh Kumar challenging interim bail granted by the Munsiff JMIC R S Pura through Advocate A K Sawhney.
Justice Javed Iqbal Wani after hearing A K Sawhney Advocate - the counsel for the petitioner stayed the proceedings in the bail application before the Trial Court of Munsiff JMIC R S Pura in bail plea moved by Sham Singh, Sukhvinder Kumar and Rajinder Kumar of RS Pura.
Sawhney submitted that the petitioner has sought the quashing of interim bail order passed in an offence which prescribes the life imprisonment before Munsiff RS Pura. He submitted that the complainant Bachan Lal of RS Pura who is father of the victim. Advocate Sawhney urged before the court that it is settled provision of Law that offence which involves the life imprisonment can’t be granted bail and secondly the offence of abduction with head injuries which are fatal and is only triable by Court of Sessions and not by Munsiff.
Advocate Sawhney further pleaded that the victim was referred to Chandigarh for treatment and police termed it as discharged which is factually wrong. CD diaries were wrongly mentioned that the victim was discharged. Justice Javed Iqbal Wani after hearing Sawhney issued notice and stayed the proceedings.
