Crime Branch registered a case against the accused person namely Ram Lal Sharma S/o Neel Kanth Sharma R/o Sarda Tehsil Hiranagar Distt. Kathua who presented a sale deed in the court of sub-Registrar (Sub- Judge) Jammu along with one fake affidavit form registration.
A written complaint duly signed and endorsed by Sub- Registrar (Sub-Judge) B.S. Bahu was revived in Crime Branch , wherein it has been alleged that the accused presented a sale deed executed in favor of Smt Ambita Bhatia W/o Grish Chander Bhatia R/O 28-BC. Gandhi Nagar Jammu for registration on 26.06.2008 accompanied with an affidavit alleged to be sworn by Karnail Singh authorizing the accused to sell his land comprising Khasra No 3-min Khata No 18 min and Khiwat No-1 measuring 11-marlas situated at village Channi Kamala Teh. Jammu.
When the sale deed was presented by the accused it was get verified that whether any affidavit authorizing the accused to sell the land has been sworn by Karnail Singh. Karnail Singh flatly refused to have sworn the alleged affidavit in favour of accused. He further deposed that he cancelled the power of attorney on 04.06.2008 executed and registered in favor of accused on 03.05.1991 and which was not authenticated for the purpose of sale. He further stated that he gave notice regarding the cancellation of power of attorney to the accused and also filed caveat petition before the Hon’ble court not to register any sale deed regarding the aforementioned land.
The Ld. Sub-Registrar has also stated in the complaint that a suspicious was caused regarding the genuineness of the affidavit when accused escaped from the court on seeing Karnail Singh. Karnail Singh also denied his signature on the affidavit. According to Ld. Sub-Registrar, the accused fabricated the affidavit with an intention to sell the land of Karnail Singh a nd also tried to play fraud with the court and should be booked under law.
On receipt of this complaint, it was sent to Crime Branch for grant of approval for registration of case. Accordingly the crime Head Quarters approved for the registration of case against the accused person. |
