Justice Sunil Hali of J&K High Court Jammu wing, in a petition filed by Swami Hari Baket Chaitanya (renowned Yogi), today directed the state Government to pay the compensation/ rent as assessed by the Additional Deputy Commissioner Udhampur to the petitioner within a period of two months and further directed to pay future rent also to the petitioner till the property is in the occupation of the respondents. Justice Hali, after hearing Adv VR Wazir appearing for the petitioner, Pratiba Mahajan and Adv Nirmal Kotwal appearing for the respondents, observed that state in exercise of its power eminent domain can acquire the property provided the compensation is paid to the owners. Court vide order January 17, 2001 had directed collector Additional DC Udhampur to hold an enquiry in the matter regarding the compensation/ rent payable to petitioners from May 1994 onwards. The Additional Deputy Commissioner submitted his report on October 1, 2001 in which the Deputy Commissioner found the petitioners entitled to receive a rent of Rs 20, 68, 928 up to September 2001. The petitioners are also entitled to the fixation of the rent from September 2001 till the property remains in occupation of respondents. Upon this Court directed the state to pay the compensation as assessed by the Additional Deputy Commissioner Udhampur and to pay further rent till the property is in the occupation of the respondents.
