| Court sentences accused to one year RI | | | Early Times Reporter

3rd Additional Sessions Judge Jammu Mr. Sanjay Gupta today awarded one year rigorous imprisonment to accused Sachin Sharma r/o Rajinder Nagar Jammu from whose possession 145 capsules of Pyrevonspos was recovered on February 8, 2008. A Case u/s 8/21/22 NDPS Act was registered against the accused.
While awarding sentence 3rd Additional Sessions Judge after hearing Additional Public Prosecutor GS Charka appearing for the state and accused in custody, observed that in all 145 capsules it comes to 9.425 gms Narcotic because FSL report shows that each capsule contains 65 mg of Dextropropoxyphene hydrochloride. The small quantity is 20 gram and commercial quantity is 500 gram as per NDPS Act and thus he has been found in possession of small quantity. The accused is sentenced to rigorous imprisonment for six months u/s 21(a) of NDPS Act. He is further sentenced RI for six moths u/s 22 (a) of NDPS Act, the Court ordered. However, both the sentences shall run concurrently. JNF |
