| Court rejects bail of accused involved in embezzlement of Rs 50 lakhs | | | Early Times Report Jammu | Sep 11
Chief Judicial Magistrate Jammu Mr. YP Bourney rejected the bail application of one Shanti Saroop, allegedly involved in embezzlement of more than Rs 50 lakhs. While rejecting the bail application CJM observed that the CPO MA Manhas strongly opposed the bail application on the ground that the applicant has not at-all cooperated with the investigating agency and did not bother to go to the IO despite the direction of the Court. The applicant had obtained bail in anticipation of his arrest even prior to the registration of the case. The IO has been deprived from subjecting him to custodial interrogation. CPO MA Manhas further submitted that the custodial interrogation of the applicant is vital particularly in the heinous crime like the present one involving embezzlement of more than Rs 50 lakhs as such applicant does not deserve to be enlarged on bail and the investigating agency may be allowed to arrest him. Another application has been filed by the Additional SP Rural Incharge SIT that applicant is required for custodial interrogation since he has not replied some vital aspects of the case. Court further revealed that the CD file and FIR against the applicant which was registered on January 28, 2008 on the complaint of Balwant Singh, the applicant is involved in the commission of offence u/s 420/467/468/471 RPC. The applicant filed the application on May 26, 2008 and was granted interim bail for the reason that he had met with an accident and the interim bail came to be extended for the one reason or the other. Keeping in view the allegations against the accused, the nature of evidence, the stage of investigation and gravity of offences as well as request of the IO, court is of the considered view that applicant does not deserve to be enlarged on bail. With these observations Court rejected bail application of the accused. JNF |
