| Illegal occupation: HC orders inquiry | | KATHUA QUARTERS | | EARLY TIMES REPORT JAMMU, Sept 19: Taking suo-moto cognizance of the newspaper report and treating it as PIL, the Division Bench of Jammu and Kashmir High Court, Jammu, comprising Chief Justice Manmohan Sarin and Justice Sunil Hali, today issued notice to Advocate General and Deputy Commissioner Kathua. The news item which was treated as PIL and published today in the local newspaper under the caption "who's living in these Govt. Quarters”, the Division Bench took judicial notice of the news-item and directed the Registry for issuance of notice to the Advocate General and Deputy Commissioner Kathua, to submit a status report giving the particulars regarding number of quarter, names of allottes and names, address of persons actually in occupation, date of allotment/ date of occupation, basis of occupation, authorized or unauthorized occupants. The DB further directed Deputy Commissioner Kathua to submit the status report on or before October 13, 2008 with the direction to the registry to list the matter before a bench of which Justice Sunil Hali is a member. DB also appointed Adv SK Anand to assist the Court in this PIL. The paper in its news item had interalia reported that in the PWD colony at Kathua, 125 quarters are stated to be occupied by retired Government employees, local employees, employees transferred out of station and other non-government employees, who weree not entitled to occupy the same. The paper further stated that the quarters were meant primarily for out-stationed employees but they have not been accommodated in the colony. Occupation of Government quarters by un-authorized person has become menace, which needs to be contained and curbed. |
