| Court snubs VO, orders re-probe | | | EARLY TIMES REPORT JAMMU, Sept 20: The State Vigilance Organization today received a great set back when the Special Judge Anticorruption Jammu, B L Bhat disagreed with the closure report filed in the court after 12 years of investigation and directed for reinvestigation of the same. Chairman Employees Forum had approached IG Crime & Railways with the complaint that land measuring 27 Kanals at Nai-Basti Satwari Jammu belonging to Irrigation Department was grabbed through fraudulent means. The king-pins in the racket were identified as SKS Ulfat and Sukhdev, both Assistant Executive Engineers. The Dy SP Crime & Railways conducted enquiry into the allegations. The investigation culminated in its closure as "Not Proved" and the final report was filed on March 29, 2006 for appropriate orders. Special Judge Anticorruption, after hearing CPO for the Vigilance organization, observed that the conclusions derived from the material assembled during investigation warranted a pro-active approach. Closing of investigation of this case virtually amounts to abdication of authority and exposing the vital interests of state to peril. There can be no dispute with the proposition that the Vigilance Organization has to protect the interests of state and encroachers of state property to justice. Condonation of usurpation of state land by land grabbers would amount to complicity in the crime. The record on the file reveals a very disturbing state of affairs. Despite clear directions of the High Court, the encroachers appear to be enjoying the benefits of encroachment of state land. Closing of investigation in the given circumstances cannot be sustained and same is liable to be set-aside, court ordered accordingly. Court directed that case shall be re-investigated by a senior officer not below the rank of Dy SP and this Court shall be posted with the developments in investigation at the end of every month. With these orders and observations, Court dismissed the final report for closing the case and ordered reinvestigation of case. JNF |
