| HC asks for affidavit in petition against excise guards’ selection | | | EARLY TIMES REPORT JAMMU, Sept 22: Justice Nirmal Singh of J&K High Court Jammu Wing, in a petition seeking quashment of 230 selectees class IV in the Excise & Commercial Tax Dept, has directed Chairman of Selection Committee to file an affidavit giving the names of those who were the members of team which conducted the physical measurement tests of the candidates along with the relevant dates. This direction was passed in a petition filed by Mohinder Kumar and Ors challenging the selection of 230 candidates for the post of Guards and orderly in which the petitioners, who claim to be a higher qualified as B.Sc, B.Ed, M.Ed, one of the petitioner is having degree of B.SC and Diploma in computer software, who had applied for the post did not find their names in the selection list published in the newspaper on February 9 last year. The petitioners alleged that the selection list shrouded with mystery as in the case of 50 selected guards their names did not figure in the short-listing and 23 orderlies too failed to make it in the short listing. During the course of arguments, Adv HC Jalmeria with Advocates Sudershan Sharma and Nitin Bhasin, argued that as per the advertisement notice the minimum height required was 5'- 4" and chest measurement was 32" without expansion and 34” with expansion so far the post of guard was concerned. It is, however, stated that no physical measurement test was conducted by the respondents before making selection. Advocate General AH Naik appearing for the state respondents submitted that as the number of the applicants was larger, a short listing criterion was adopted and as per the criteria, the minimum height for guards was fixed as 5'-11" and in case of reserved category it was fixed as 5'-10". Advocate General further stated that the members of the committee who made the selection had conducted the physical measurement test also. Upon this the Court pointed out to indicate the dates on which the physical measurement test was conducted, the Advocate General failed to address the court on this aspect. Even perusal of record which was produced in the open court did not reveal any dates on which the said test was conducted. Court directed Chairman of Selection Committee to file his affidavit. JNF |
