| Guns not laws can tackle terrorism | | | Nirbhay Jammual
Following escalation in the level of militancy related violence in various states in India the demand for stringent laws for tackling terrorism continues to soar.Do we need tough laws to deal with terrorists ?The question is debatable.It has already divided the political spectrum in the country.The Congress led UPA Government seems to be a confused lot,though the level of confusion and conflict has receded after the success of Delhi police in nabbing all those who were involved in the recent serial blasts in Delhi and Ahmedabad.The UPA Government seems to have been placed in a well of confusion following the allegations levelled against it by the BJP and its allies for having scrapped the POTA.The UPA Government is on record to have stated that it was against the revival of POTA but would have an effective anti-terrorist law.What that law will be only future events will determine ? One needs to examine the impact of TADA and POTA on terrorism.Once it is done one will find that the level of terrorism kept on rising in India during the time TADA and POTA were in force in the country.And both these laws were tough but it did not scare away terrorists from the country.Instead these laws gave an opportunity to police officers,bureaucrats and political leaders for settling their personal and political scores.A large number of innocent people were forced to languish in jails.Some lost their valuable assets,others sold their assets for a song when they were threatened to be hauled under either TADA or POTA.Security experts,including former DG Police,K.P.S.Gill,who has the credit of freeing Punjab from the menace of militancy is against adoption of stringent laws or for readoption of eiher TADA or POTA.He too makes it clear that such laws are usually misused.Others say that even if you have strict laws poor implementation of the provisions of those laws rob the anti-terrorist Act of its vigour and utility. They say India has anti-child labour laws but the number of child labourers and their exploitation keeps on swelling.They wish to ask "have laws discouraged traders in indulging in hoarding and profiteering ?"No.There is a law which bans subjecting pregnant women to sex determination test.Is it being enforced trictly ? No,because in hundreds of villages and towns in the country doctors have been thriving on it.What is then the need for adopting a new anti-terrorist law when the terrorists are not scared of these laws?People and political leaders need to realise that when terrorists are not scared of gun wielding troops and paramilitary forces will they be unnerved by a mere law.What is then the alternative ? First of all the porous borders be effectively sealed.A mechanism has to be evolved so that not a soul is able to cross into the Indian territory.Secondly,the security personnel,right from the police station,be equipped with latest gadgets and weapons for countering militants who are in possession of high tech.weapons and gadgets.Thirdly,deployment of the security personnel on the borders and inside the towns,even in villages,be increased alongwith increase in the manpower in intelligence agencies.At least each state should have an intelligence unit meant for gathering information about the activities and plans of terrorists.Above all security personnel be given fresh training in tackling militants so that the right person,not the innocent or wrong person,is targeted."Catch and kill" be the new pattern for tackling terrorism.Tackle the terrorists with guns and not with law. |
