| ARTO Kathua’s suspension stayed | | | EARLY TIMES REPORT JAMMU, Sept 25: Taking serious note of overriding the powers, the Jammu and Kashmir High Court, today stayed the operation of the suspension order of V K Duggal ARTO Kathua, who was placed under suspension by the Deputy Commissioner during an inspection of the office. VK Duggal Assistant Regional Transport Officer Kathua, in a petition challenged the order. Senior Adv U K Jalali assisted by Neha Bakshi, who appeared on behalf of the petitioner, submitted that since the Deputy Commissioner was not the appointing authority of the petitioner, therefore he was not competent to suspend the petitioner. He further submitted that in case the Deputy Commissioner, while inspecting, found that the office of the petitioner closed, he should have made the report to the competent authority instead of suspending the petitioner. During the course of arguments, Sr. Adv UK Jalali referred a case where the Deputy Commissioner had also suspended one KK Khajuria Senior Project Officer National Fish Seed Farm, Kathua, who's appointing authority is Government but the Government has revoked the order of suspension of said officer. Upon this Justice Nirmal Singh after hearing the counsel for the petitioner directed that in view of the submissions made, issue notices to respondents' returnable within a period of four weeks and in the meanwhile operation of impugned order dated August 9, 2008 shall remain stayed.
