| Equal pay, equal work: HC | | | EARLY TIMES REPORT JAMMU, Sept 26: Justice Nirmal Singh of J&K High Court Jammu Wing in a petition filed by Legal Assistants seeking equal pay for equal work held the petitioners entitled to the grade of Rs 6500-10500 which was attached to the post of Legal Assistant and directed the respondents to pass appropriate orders releasing the grade of the petitioners within a period of one month. This significant judgment was delivered in a petition filed by Ajay Singh Jasrotia and others seeking quashment of order January 31, 2004 whereby the respondents have created Additional post of Sr. Additional Legal Assistant in the grade of Rs 6500-10500 and placement of post of legal assistant in the grade of Rs 5500-9000 and also seeking directions to respondents to release the grade of Rs 6500-10500 in favour of the petitioners. Justice Nirmal Singh, after hearing Adv KS Johal appearing for the petitioners and Adv DS Parihar appearing for the respondents, observed that in the present case nature of work being performed by the petitioners is similar to those legal assistants working in other departments of the state and autonomous bodies. The classification made by the respondents in giving different treatment by lowering the pay-scale attached to the post of legal assistants against which the petitioners have been working is not based on any rational and by this act of theirs, the petitioners who are similarly situated and performing the same nature of duties as being performed by their counter-parts in other departments of the state, have been deprived of their right of equal pay for equal work and hold that petitioners are entitled to the pay grade of 6500-10500 which was attached to the said post. Court directed the authority to pass appropriate orders releasing the grade in favour of the petitioners within a period of one month. JNF |
