| Murder accused acquitted after 10 years | | | EARLY TIMES REPORT JAMMU, Sept 26: Principal Sessions Judge Jammu Mr. JR Kotwal acquitted one Santosh Kumar alias Lokesh Kumar resident of Tarooni, District Darbanga (Bihar), who was facing trial for the last 10 years in a murder case. According to the prosecution case on June 20, 1998 one Raj Kumar lodged a verbal report with the police station Nowabad about suspicious death of his brother Mohan Lal age 19/20 years. After recovery of the dead-body, the post-mortem was conducted revealing that the cause of death of the deceased was by strangulation. Police thus registered a case u/s 302 RPC and took-up the investigation. During the investigation it was established that accused Santosh Kumar and co-accused Som Singh, who were friends of the deceased, had committed the murder of the accused on some issue. Principal Sessions Judge, after hearing Public Prosecutor appearing for the state and Adv BB Kotwal appearing for the accused persons and going through the record of the case and statement of witnesses, observed that as per the prosecution case the lace of shoes used for the commission of the offence and a pair of shoes without laces was recovered from the house of accused Som Singh on the basis of disclosure statement. The real brother of the deceased, however, had not supported the prosecution case and was declared hostile. In the result recovery of the object used in commission of offence shoe lace has not been proved. This sans the prosecution case of the important link in the chain of circumstances, had they otherwise being proved, Court held that the charge against the accused Santosh Kumar is not proved and as such is acquitted from the charges. The co-accused Som Singh, a juvenile, tried separately in the juvenile court, was acquitted on January 14, 2008. |
