Teenager convicted for attempt to commit murder of his teenager friend

Jammu, September, 11-:- Third Additional Sessions Judge/Presiding officer TADA/POTA Wani ND today convicted Kuldeep Singh, who was facing trial having committed offence of attempt to commit murder of his teenager friend Harjinder Singh by throwing him deep well.



In the prosecution case accused and victim happened to be the friends on August 20, 2001, accused Kuldeep Singh took Harjinder Singh towards Peer Baba where they sat on the top edge of the well, the accused caught hold of victim from the leg and threw him in the well with criminal eliminate him and went away from the place of occurrence. Next morning about 8:30 AM few people of the area found boy in the well helpless and they took him out of the well and brought to his home, where he narrated the episode. It was alleged that there was charge against the accused used to tease sister of the victim.



While convicting the accused after hearing both the sides observed that there is neither any enmity as been established against the accused. But the prosecution has succeeded in proving the charge against the accused u/s 307 RPC beyond any reasonable doubt. Accused would have been guilty for the commission of offence u/s 307 RPC and therefore he is convicted.



On the quantum of sentence an application for release of accused on Probation of Offenders Act on the ground that at the time of offence was committed, the accused was of teen age as even on today he is a teenager with no criminal liability.



Wani ND after considering the facts of the case observed that the circumstances in which the offence was committed and the accused was also in fact teenager and he being first offender, Court is of the opinion instead of sentencing the accused he should be released on Probation of Offenders Act. Accordingly the accused is released on probation on executing personal bond with a surety of Rs 25000/- and an undertaking to keep peace and good behaviour for a period of one year, in case of any default committed by the accused, besides forfeiture of surety bond, he will undertake to appear and received such sentence as may be awarded to him. Court further ordered to accuse to pay compensation of Rs 1000/- to the victim.
