| Rapist of 8-year girl denied bail | | | EARLY TIMES REPORT JAMMU, Oct 1: 2nd Additional Sessions Judge Jammu, ML Manhas rejected the bail application of 17 year Gourav Sharma, allegedly involved in a rape case of 8 year old girl on August 12, 2008. 2nd Additional Sessions, after hearing Adv Abhinav Sharma appearing for the petitioner and APP Ravinder sharma appearing for the state, referring various judgments, observed that rape is the most hated crime in the society and is violative of fundamental rights of victim, as contained in the Article 21 of Constitution of India. A rapist not only causes physical injury on the victim but also leaves an indelible scar on the victim, most cherished possession. The victim in the case in hand is a minor girl of 8 years age and this court loose sight of the fact that violence upon minor children are on increase and therefore, the perpetrators of such crime must be dealt with iron hands. The leniency in matters involving sexual offence is not undesirable but also against public interest. Showing leniency in such matters would be really a case of misplaced sympathy, if leniency is exercised in favour of the accused at this stage it will amount to encouragement him and he may repeat the offence. With these observations court rejected the bail application. JNF |
