| LeT sympathizer’s PSA quashed | | | EARLY TIMES REPORT JAMMU, Oct 4:Quashing the detention of Mohammed Taj Gujjar, code Dilawar code Tariq of Tehsil Mendhar District Poonch, who was arrested on March 10, 2007 along with associates Feroz Ahmed and two Pak militants of Let outfit and detained under PAS by the order of District Magistrate Jammu passed on June 30, 2007,Justice Virender Singh of Jammu and Kashmir High Court observed that Court does not find any material on record to support the impugned detention order passed by the District Magistrate Jammu whereby the detenue was detained under Public Safety Act. Court allowed the petition and quashed the detention order passed by DM Jammu on June 30, 2007 with the direction that detenue, who is presently lodged in District Jail Jammu, shall be released from custody forthwith, if not required in any other case. Delay in execution of the order shall be taken seriously, Court said. Justice Singh, after hearing Adv S.H Rather appearing for the detenue and AAG SC Gupta appearing for state, observed that so far as flaws pointed out by counsel for the detenue with regard to the non-supply of dossier or the material to the detenue, the court is of the view that it does not call for any detailed discussion as AAG SC Gupta has fairly stated that no material was supplied to the detenue. |
